ARTICLE 1. - SCOPE
1.1 These Terms and Conditions (T&CS) are intended to govern all of our services and in particular:
The relationship between our platform and its users (part 1),
The rules applicable to the user community (part 2),
The rules applicable to any purchases integrated into our platform (part 3).
1.2 Acceptance of these T&CS is indicated by a mandatory check box when subscribing to our services as a user.
1.3 Our T&CS are freely accessible on our websites and will prevail, where applicable, over any other version or any other conflicting document.
1.4 The user declares to have read and accepted them before providing all our services.
1.5 These T&CS may be subject to further amendments which application will be subject to user acceptance. If the user does not accept said changes, we reserve the right to suspend or terminate all or part of our services.
1.6 The company WEBSUN Solutions UG, Erich-Weinert-Str. 29, 10439 Berlin, Germany, registered under German law, is the Publisher of the services (hereinafter “the Publisher”). You may contact us by post and email. The publishing director is Eric Couchelou.
1.7 The host of our websites is Infomaniak Network SA, 26 Avenue de la Praille, 1227 Carouge/Geneva, Switzerland, (Tel. +41 22 820 35 44).
Article 2. – DESCRIPTION OF SERVICES

Article 3. – SUBSCRIPTION ON OUR PLATFORM
3.1 Subject to the paid Services as mentioned in part 3 of the T&CS, our Services are available free of charge and freely to all Internet users. However, following subscription, the user may contribute to uploading content and enhancing the offer on our platform.
3.2 To subscribe, the user must fill out the form provided. When subscribing, the user must choose a username and a password. The User guarantees the accuracy and updating of this personal data. In the event of obviously fake, incorrect or fanciful data, the Publisher is free to suspend or close the user's account at any time and without notice.
Article 4. – RESPONSIBILITY OF THE PUBLISHER
4.1 The Publisher is responsible for the correct implementation of obligations resulting exclusively from his own Services. Therefore, he can be exempted from all or part of his liability by providing proof that the non-implementation or poor implementation of his Services is accountable either to the consumer, or to the actions of a third party to the contract, or to a case of force majeure.
4.2 Therefore, and subject to public policy provisions, the Publisher cannot be held liable in the event of:
use of the Services in a manner not provided for in the user documentation, or use not expressly authorized by these T&CS;
modification of all or part of the applications or of the information and content accessible via the Services not carried out by the Publisher;
use of all or part of the Services when the Publisher, due to a problem or for any other reason whatsoever, had recommended to suspend their use;
use of the Services in an environment or setting that does not meet the Publisher's technical prerequisites, or in connection with third party programs or data not expressly endorsed by the Publisher;
loss of user content, when the user has not taken the precaution of backing up his data independently of the Services;
the occurrence of any damage resulting from the error or negligence of the user, or that the user could have avoided by seeking the advice of the Publisher;
use in connection with the Services of programs not provided or endorsed by the Publisher and likely to affect the user's computer system.
